The consequences of the ECJ ruling on mutagenesis techniques

The Court of Justice of the European Union's ruling on a number of new mutagenesis techniques (NBTs) means that varieties produced using new mutagenesis techniques must be considered GMOs. Therefore, they can only be included on national variety lists if they have been pre-approved under the EU's GMO legislation. This follows the ECJ's judgment in a landmark case (C-518/16), which was delivered on 25 July 2018.

TystofteFonden has therefore included a clarification in our application forms, so that reviewers of new varieties will in the future have to answer whether ”the variety is genetically modified (GM) or if the variety originates from a genetically modified variety that is subject to GM regulation? pursuant to EU Directive 2001/18/EC, Annex 1 A, Part 1 and by virtue of the EU Court of Justice's ruling (C-518/16) of 25 July 2018".

We urge that the updated review forms be used for new reviews and technical questionnaires from our website – alternatively, we will subsequently request documentation regarding the GMO status of the varieties.
